CRIMINAL LAW ENFORCEMENT IN RELATION TO ROAD TRAFFIC ACCIDENT CASES IN PARIGI MOUTONG REGENCY

Abstract

Traffic accidents remain one of the most common incidents in society and often result in property damage, physical injuries, and loss of life. In this regard, criminal law enforcement serves as an essential instrument for ensuring legal certainty, justice, and protection for the public. This study aims to examine the effectiveness of criminal law enforcement in handling traffic accident cases in Parigi Moutong Regency and to identify the factors that influence its implementation. The research employs an empirical legal method using a socio-juridical approach. Primary data were gathered through interviews with law enforcement officers and relevant stakeholders, while secondary data were obtained from statutory regulations, legal literature, official records, and related academic publications. The findings reveal that the enforcement of criminal law in traffic accident cases has generally been carried out in accordance with the provisions of Law Number 22 of 2009 concerning Road Traffic and Transportation. Nevertheless, its effectiveness has not yet reached optimal levels due to several challenges, including limited public legal awareness, inadequate supporting facilities and infrastructure, geographical constraints, and the widespread use of restorative justice mechanisms in resolving cases. These factors significantly affect the overall performance of law enforcement and public compliance with traffic regulations. Therefore, strengthening the competence of law enforcement agencies, improving legal awareness among citizens, enhancing supporting infrastructure, and fostering better inter-institutional coordination are necessary to establish a more effective and sustainable traffic law enforcement system.
