Analisis Hukum tentang Rukun dan Syarat Wakaf Berbasis Teknologi Digital

Abstract

Waqf is an Islamic economic instrument that plays a crucial role in social development and community welfare. In the digital era, technology has significantly transformed waqf practices, enabling online waqf transactions through various digital platforms. This study analyzes the legal certainty of technology-based waqf by examining the application of waqf pillars and requirements in this context. The research employs a normative juridical approach by analyzing relevant legislation and Islamic legal concepts regarding waqf. The findings indicate that although digital waqf has a legal foundation in Indonesia’s positive legal system, challenges remain in its implementation and regulation. Factors such as the validity of online waqf contracts, legal protection for waqifs, and data security in digital transactions require further attention. This study aims to clarify the legal aspects of digital waqf and encourage regulations that are more adaptive to the development of Islamic financial technology.
